Medical Marijuana—What does it mean for Lyons?

 

Background:  In November of 2000, Colorado voters approved an amendment (Amendment 20) to the State’s constitution to permit the use of medical marijuana to treat specific debilitating medical conditions.  Because federal law still prohibits the possession and use of marijuana, the impact of the state action was not significant.  But in 2009, the federal government authorized the use of medical marijuana, as long as it complied with state law.  This has resulted in the rapid growth of an industry to grow and sell marijuana for medical purposes. 

 

Amendment 20 provides considerable definition and regulation of a medical marijuana patient and caregiver, but it does not address the establishment of dispensaries or growing operations to serve the increasing number of medical marijuana patients.  This is where the community impact is seen.  The Town of Lyons Board of Trustees has no interest in interfering with the rights of patients to obtain their medical marijuana, or their privacy, both of which are protected by Amendment 20.  But concerns have been expressed about the establishment of dispensaries in residential neighborhoods, appropriate zoning districts, privacy issues, proximity to schools, and other matters of local interest.  Some residents and businesses welcome the opportunity for new visitors, businesses, and revenue.

 

Current Status:  The Board of Trustees has approved an ordinance establishing a moratorium on the opening of new dispensaries or growing operations for medical marijuana.  It began on January 8 and extends to April 9.  This will provide an opportunity for the Town to have an active public discussion about community concerns on this issue, to receive some guidance from pending state legislation, and to observe the implementation of regulations in some other communities.  There are currently three dispensaries open on Main Street, one home-based business is licensed, and two more licenses have been issued—none of these will be affected by the moratorium.  This is such a new industry that the Town’s zoning code does not seem to cover it.  Is a medical marijuana dispensary a medical clinic? A “personal services” business?  Is a growing operation “agricultural” under the zoning code?  Could there be too many dispensaries?  How can we protect the privacy of patients?  Are there crime impacts?  Some medical marijuana advocates propose that no regulation is necessary, and some support regulation in order to “legitimize” the industry and provide quality control.
